There's a notorious weird law in Texas that deals with adult "devices" that are usually marketed as massagers, but we all know what they're really for. In 1973 it became illegal for someone to own six or more of them. According to the Penal Code, if someone has six or more, they obviously intend to "promote the same". Even though it's not ever really enforced, it's still on the books.

In 2025, the Texas legislature is once again going after these "obscene devices".

Think about the last time you went to Walmart, CVS, Walgreens, or even Target. You're walking through the health and beauty section and what do find adjacent to it? A small section devoted to sexual health or "personal intimacy".

There are all kinds of lotions, contraceptives, and contraptions on display. Some Texas lawmakers want what they consider to be "obscene devices" pulled from these stores where families shop. If you like to go shopping for groceries and then stop to pick up a little something for yourself, you may soon be out of luck.

Why Do Texas Legislators Want Sex Toys Pulled From Store Shelves?

If you pay attention, at all, to what usually inspires these types of crusades in our state's capital, you'll know it has to do with the children. Apparently, some lawmakers feel as if these products being in stores like Walmart or Walgreens is harmful to children; and we know the Texas legislature is always worried about the children.

They feel these types of devices should be relegated to the type of stores you usually have to leave town to visit so no one recognizes you. Either that or you go really late at night. The lawmaker responsible for the bill believes that these devices belong only in adult toy stores.

HB 1549 wouldn't just pull these items from shelves across the state but also lines out some pretty harsh penalties if the items deemed obscene continue to be sold. It's suggested that fines not exceed $5,000 per offense.

Whether or not this becomes law depends on it ever being debated and voted on in the first place. This legislative session is already proving to be an odd one, and it's anyone's guess as to whether or not this gets any traction.
